A car dealership in Wichita, Kansas, and its owner have been held in contempt of court, leading to the owner being sentenced to jail time.
Sedgwick County District Attorney Marc Bennett has taken action against 37 Auto Sales LLC and its owner, Jacobs Lucky. The DA’s Consumer Protection Division has filed a show cause motion, alleging that the dealership and its owner have violated a court order by continuing to sell cars.
The court found that the dealership and its owner violated the court’s orders by selling six cars, despite being explicitly prohibited from doing so. After carefully considering the testimony and reviewing the documentary evidence, this violation was confirmed.
37 Auto Sales was previously ordered to pay a total of $80,000.00 in civil fines and penalties. Additionally, Lucky was ordered to pay $30,000.00. To ensure compliance, the court also prohibited 37 Auto Sales, LLC and Lucky from selling cars in the State of Kansas until these judgments were fully paid.
The dealership defied the court’s orders and continued its operations, selling cars, despite the evidence presented by the Consumer Protection Division.
The court discovered that six cars had been sold, leading to Lucky being ordered into custody for contempt of court. Lucky was immediately taken into custody and held in the Sedgwick County Detention Facility for a period of six months.
The court has mandated that Lucky will only be released upon payment of the entire $110,000.00 to resolve the contempt charge.
On November 26, 2024, Judge Faith Johnson issued the judgment against 37 Auto Sales, LLC, and Lucky.
