Development agreement for new HyVee store, second reading of golf cart changes to be considered by Clear Lake City Council tonight

CLEAR LAKE — The public hearing on a development agreement as part of a new HyVee grocery store in Clear Lake as well as the second reading of an update to the city’s golf cart ordinance are on the agenda tonight for the City Council in Clear Lake.

=== The council will hold a public hearing and then consider the development agreement between the city and Embree Development Group. Embree plans to construct a 51,000- square foot store with related surface parking on about six-and-a-half acres of land located along US Highway 18 between North 14th and 20th Streets. The agreement includes an incremental property tax rebate agreement for ten years in a cumulative amount not to exceed $850,000, as well as a not-to-exceed $550,000 offset to be used by the developer to finance municipal water and sanitary sewer service main extensions, service laterals for the project, and to re-route a 60-inch storm sewer pipe around the building. The council will also separately consider a subdivision agreement for the 64-acre Emerald Edge Subdivision, which is currently owned and is being developed by Sukup Ag LLC. The development would include seven buildable lots and one outlot that would be subdivided at a later time. It would include new roadway paving and new underground infrastructure. The developer has requested the city participate in purchasing of water main and sanitary sewer main line pipe material for the subdivision, such as the city did for the Courtway Park Subdivision east of Interstate 35. 

=== The council will also consider the second reading of the golf cart ordinance after the council last week approved the first reading during a special session. One of the big changes is the requirement to have seat belts for people 17 and under in rear-facing seats along with the yearly permit fees being raised from $25 to $40. The council will also consider the first reading of similar changes to the city’s off-road utility vehicle ordinance. 

The council meets at 6 o’clock tonight in City Hall.
