Deaf man assaulted by Phoenix police files $3.5 million claim

A notice of claim in the amount of $3.5 million has been filed against the city of Phoenix by the deaf man who was punched and tasered multiple times by police officers in August.

According to records, Tyron McAlpin’s attorneys submitted the claim on November 18.

According to attorney Jesse Showalter, Officers Benjamin Harris and Kyle Sue from the Phoenix police force assaulted, physically assaulted, and used a taser on Tyron. Showalter further alleged that after the attack, Officers Harris and Sue, along with Officer Jorge Acosta, fabricated charges against Tyron, leading to his unjust imprisonment for a period of 24 days.

McAlpin faced legal trouble when he was taken into custody on August 19, 2024. He was charged with resisting arrest and aggravated assault. The arrest was made on the basis of allegations made by another individual, which were later discovered to be false and unverified.

The charges against McAlpin were dropped by the Maricopa County Attorney’s Office the week after ABC15 aired a video of the arrest, sparking widespread national outrage.

The Phoenix Police Department is currently conducting an internal investigation into the case.

The arrest of McAlpin has resulted in the temporary suspension of the two officers directly involved in the incident.
