Ackley man dead after Tuesday fire

ACKLEY --- An Ackley man has died after being found on fire behind a grocery store yesterday. The Iowa Department of Public Safety says that Hardin County authorities were called shortly after 3 o’clock Tuesday afternoon to the alley of the Ackley Super Foods store. On arrival, they found the garage at 509 1st Avenue near the store’s parking lot was totally engulfed in flames, however citizens had already extinguished the flames from the man on fire. 27-year-old Derek James Harrop-Miller was airlifted bound for the University of Iowa Hospitals and Clinics’ burn unit, but he died while in flight. An autopsy is scheduled to be held Thursday in Iowa City. The fire and death remain under investigation by the Iowa State Fire Marshal’s office as well as Ackley authorities.

Favre in Twin Cities to sign with Vikings
Breaking News      EDEN PRAIRIE, Minn. (AP) - Brett Favre is on his way to Minnesota to meet with the Vikings.
     Coach Brad Childress confirmed in an e-mail to The Associated Press Tuesday morning that the veteran quarterback was traveling from Mississippi to meet with the team.
     Asked if the plan was to sign Favre on Tuesday, Childress replied: "In a perfect world."
     Favre, a longtime star in Green Bay, came out of retirement last season to play for the Jets. He retired again, only to then entertain the idea of joining the Vikings. Last month, Childress said the quarterback would stay retired.

Court of Appeals upholds Johnson murder conviction

DES MOINES --- The Iowa Court of Appeals has upheld the conviction of a Mason City man accused of murdering his mother and holding his step-father captive in the couple’s basement. Jordan Johnson appealed his conviction on charges of first-degree murder and second-degree kidnapping saying that his lawyer failed to object to testimony given by a forensic psychiatrist testifying for the defense during the prosecution’s cross-examination. Doctor William Logan on cross-exam was asked by prosecutors if in his opinion that Johnson’s murder case was not one where diminished capacity applies. Logan answered that (quote) “if you look at it from a very narrow standpoint and without looking at the rationality of what he did, then I would agree with that.” Logan also stated later that he made the same assessment in an earlier deposition. Johnson alleged that his counsel’s decision to allow those questions breached an essential duty in his diminished capacity defense. The court determined that the case is not sufficient for it to address Johnson’s claims of ineffective assistance of counsel, concluding the issue should be preserved for possible post-conviction proceedings. That would allow Johnson’s attorney to explain her reasons for not objecting to the challenged testimony. Johnson was convicted of the hatchet murder of his mother Rita Seely on January 19th of 2008 at her home in southeastern Mason City, then detaining step-father Phil Seely in the home’s basement so he could escape.
