Appeals court rules against Fenzloff
Breaking News DES MOINES --- The former owner of a rural Charles City cemetery has lost an appeal of her theft and fraud conviction. The Iowa Court of Appeals today affirmed a district court judge’s decision in the first-degree theft and second-degree fraudulent practice case of Mitzi Fenzloff. Fenzloff and her husband Albert were charged after taking over ownership of the Sunnyside Memory Gardens in 2003, selling pre-need funeral services without the required permits to do so, and without depositing 80-percent of those funds into trust accounts as required by Iowa law. Court documents estimated that of the $51-thousand the couple received from pre-need service transactions that only $980 was place into a trust account. District Judge John Mackey last September found the Fenzloffs guilty on the charges on a trial on the minutes, sentencing Mitzi Fenzloff to 10 years in prison due to her prior criminal record, while Albert Fenzloff received a suspended five-year prison sentence and three years probation. Fenzloff appealed the decision saying there was insufficient evidence to support her conviction and that her counsel was ineffective. The appeals court rejected Fenzloff’s arguments, stating in their written decision that Fenzloff “acted in a manner that was plainly inconsistent with the owners’ rights in such property.” The court did preserve Fenzloff’s claim of ineffective assistance of counsel for possible post-conviction relief proceedings.
